1. Scope

1.1 Nexigen Digital Pty Ltd (Nexigen Digital) recognises the importance of protecting the privacy and the rights of individuals in relation to their personal information. This document sets out our privacy policy, and explains how we collect and manage your personal information in the course of performing our functions and activities.

1.2 We respect your rights to privacy under the Privacy Act 1988 (Cth) (Act) and other applicable laws that protect your privacy. We are committed to complying with these laws, including the Australian Privacy Principles (APPs) which are set out in the Act, and regulate how we must handle your personal information. We may rely on the applicable exemptions in the Act.

1.3 Nexigen Digital is the parent company that operates the following online brands that offer various types of digital services and online solutions:

 

VentraIP: Retail digital service provider specialising in direct to consumer domain names, websites, email and other online solutions.


Synergy Wholesale
: White-label wholesale platform designed for reselling and managing larger portfolios of specialised digital services including domain names, websites, email and other online solutions.


Intaserve
: Corporate brand management platform specialising in domain management, trademark and brand protection, DNS management and other bespoke online solutions.

 

1.4 The Nexigen Digital team oversees operations across all brands and in many cases the same underlying team, technology and infrastructure is used across all brands where each brand is tailored to serve a specific area of the digital service and online solutions market.

1.5 This privacy policy details how Nexigen Digital collects and uses Personally Identifiable Information (PII) defined as any information that can be used to identify a specific individual, either on its own or when combined with other information. This includes direct identifiers like names and email addresses as well as indirect identifiers such as phone numbers and IP addresses.

1.6 Nexigen Digital is an approved Gateway Service Provider (GSP) for access to the Australian Government’s Document Verification Service (DVS).

1.7 Synergy Wholesale performs identity matching services for the purposes of validating registrant data for .au domain name licences where the registrant has opted to use the eligibility type ‘Individual/Citizen’.

1.8 VentraIP is a Synergy Wholesale partner for the purposes of domain name registrations and where customers chose to validate their identity as an individual for the purpose of registering a .au domain name, the validation process is handled by the Synergy Wholesale system where data is never stored and only transmitted for a yes/no verification response.

 

2. Collecting your Personal Information

2.1 Nexigen Digital is subject to the Privacy Act 1988 (Cth).

2.2 Nexigen Digital collects personal information you give us through direct interactions (e.g. placing orders, phone calls, live chat enquiry, email submissions) and some automated means (e.g., cookies and logging).

2.3 Information collected during direct interactions includes the following:

 

Placing an order with us: Your name, email address, street and/or portal address, telephone number, IP address and web-browser user agent.


Interacting with us via the telephone
: Your telephone number, voice recordings and account identification number.


Interacting with us via live chat on our website
: Your name, email address, phone number, IP address and web-browser user agent, history and interaction of pages visited on our website.


Submitting a ticket enquiry
: Your name, email address, phone number, IP address, web-browser user agent and account identification number.

 

Contact form submission: Your name, email address, phone number, IP address and web-browser user agent.

 

2.4 Any payment data such as credit cards supplied for service provisioning and invoice payments are stored by a secure third party payment processing provider.

2.5 Customers can verify eligibility for .au direct domain names using a driver’s license, passport, or Medicare card. This information is transmitted and validated; the identifier is at no time stored by Nexigen Digital.

2.6 Nexigen Digital may collect personal information through our partners, agents, resellers or affiliates.

2.7 Nexigen Digital collects the information you give us either online or by email, post, facsimile, face to face, over the phone or through our partners, agents, resellers or affiliates. In most cases, the personal information Nexigen Digital will collect from you is the personal information required in order to provide services to you. This information may include your full name, postal and/or physical address, telephone number, email addresses, ABN or ACN, facsimile number, IP address and other relevant details.

2.8 Nexigen Digital makes use of cookies on all our website properties. A cookie is a small piece of data given to your web browser by our server in order to store information about preferences you may have set. Cookies are also used to track certain interactions with our website and to provide a more personalised experience. You can disable cookies by turning off said functionality in your web browser. Please bear in mind that this may result in the experience becoming degraded.

2.9 We may also collect some information that is not personal information because it does not identify you or anyone else. For example, we may collect anonymous answers to surveys or aggregated information about how users use our website.

2.10 Nexigen Digital operates its infrastructure in NEXTDC Tier IV data centres in Melbourne and Sydney. Customer data that Nexigen Digital holds is stored on infrastructure in these facilities based in Australia.

3. Why we collect your Personal Information

3.1 We collect and use your personal information to deliver Service(s) to you. This includes any services and products from any Nexigen Digital brands including but not limited to VentraIP Australia, Synergy Wholesale and Intaserve.

3.2 We collect your personal information to create invoices, bill you, authenticate technical support requests, contact you, and for regulatory and compliance purposes.

3.3 We also may use your information to measure interactions with our Service(s), website or products; and to further develop or improve said services, websites or products. Your personal information may also be used for marketing or promotional purposes. If you do not wish to receive any marketing communication you can opt-out and stop future delivery by following the instructions in the communications sent to you which will highlight the appropriate process, or by contacting our team via email to: info@nexigen.digital

3.4 Any telephone conversations you have with us may be monitored or recorded in order to facilitate team member training and for verification purposes. You will always be informed prior to any telephone conversation, and by continuing with the telephone call you are granting approval.

3.5 Where you purchase Service(s) or products from us that are provided by a third-party we are required to collect and disclose your personal information to these providers in order for the Service(s) or products to be rendered.

 

4. Disclosure of your information to third parties

4.1 Nexigen Digital is a proudly Australian owned and operated business. Personal information you provide to us will generally be stored within Australia in accordance with applicable data protection laws.

4.2 Your personal information may be provided to third parties in order for Service(s) or products to be rendered.

4.3 We may supply your personal information to third parties in order to provide continued support, sales, billing and administrative functions.

4.4 Some third-party providers may be located outside Australia. Where this occurs, we ensure compliance with Australian Privacy Principles and data protection standards.

4.5 Nexigen Digital and all of its related entities maintain strict contracts and agreements with all third party vendors and suppliers that contain privacy and confidentiality provisions which are consistent with the Australian Privacy Law obligations.

4.6 Any information you supply to Nexigen Digital or any of its related entities may be shared within the group of related entities to facilitate provisioning, maintenance and continued use of Service(s) or products. Each and every related entity shares the same commitment to protecting your personal information.

5. Your rights and control of your information

5.1 You may access, update, or correct your personal information by logging into your account.

5.2 If you believe we hold inaccurate information, you may request a correction by contacting our team via email to: info@nexigen.digital

5.3 Where possible, we will allow you to interact with us anonymously. However, for most of our functions and activities we need to ask your name and contact information to enable us to effectively handle your enquiry or request.

5.4 If you choose not to provide us with your personal information we may not be able to assist you, provide you with our services and your experience of our websites may not be as enjoyable or useful.

5.5 You may request access to personal information we hold about you, subject to legal restrictions.

5.6 You may decline consent at any time, this may result in loss of access or service disruption, our customer service team will discuss the consequences of declining consent on a case by case basis.
